Terms of Service
Last updated October 6, 2026
1. Who we are
The Tourney (“the service”) is provided by Certamen Inc, a Canadian company (“we”, “us”). These terms apply to everyone who uses it: organizers who run tournaments, leagues and other events, and participants — players, parents and guardians, coaches, team managers, officials and anyone else taking part. By creating an account or using the service you agree to them.
2. Your account
- Give accurate information and keep your sign-in details to yourself. You are responsible for what happens under your account.
- A parent or guardian can add children to their household and sign them up. A child added this way has no sign-in of their own; the adult who added them is responsible for what is done on their behalf.
- You can close your account at any time by contacting us.
3. For organizers
Your events and the information you collect
When you run an event, you decide what information to collect from participants (rosters, forms, documents, photos). For that information you are the controller and we process it on your behalf. You confirm that you have a lawful basis to collect it, including a parent’s or guardian’s consent for children where the law requires it, and that you are entitled to upload anything you upload (for example birth certificates or medical forms).
- Use participants’ contact details only to run your event — never for marketing or anything unrelated.
- Player photos exist to confirm identity at the event. Don’t use them for anything else or publish them.
- Player photos and uploaded documents are deleted from the service 7 days after the event ends.
- Anything you export or print (rosters, contact lists, documents) is your responsibility once it leaves the service. Keep it secure and destroy it when you no longer need it for the event.
- Keep your event’s details — dates, fees, locations, refund terms — accurate and up to date.
Waivers and forms
We provide the means to collect waivers and forms; their wording and legal effect are yours. We don’t draft, review or guarantee that a waiver is enforceable where you are. A “signature” on The Tourney is a typed name or a ticked box, recorded with the time, the signer’s IP address and browser, and a fingerprint of the exact text shown. It is not a handwritten signature; if you need more, use a different instrument. Only the person themselves, or their registered parent or guardian, may sign — don’t ask anyone to sign on someone else’s behalf. If you waive a required form for someone, that decision and its consequences are yours.
Identity, eligibility and safeguarding
We present documents; we don’t verify them. The service can show you a roster, a photo and an uploaded document, but whether a participant is who they say they are, and whether they are eligible for a division, is your determination. We make no promise about the authenticity of anything uploaded. Background checks and credentials stored on the service are likewise not verified by us, and you must not suggest otherwise to participants or their families.
Money
- Entry fees are paid by registrants into your own payment account (your Stripe, PayPal or Square account, or however you choose to collect). We don’t hold them. Your payment processor’s own terms apply to those payments, and refunds, chargebacks and disputes on them are between you, the registrant and your processor.
- You pay us a platform fee for each event, as described on our Pricing page and charged to the card you add for that event, at the times shown there. Unpaid fees can lock the event for changes until they are paid.
- Taxes on your entry fees and your events are your responsibility, wherever you operate.
- Refunds of platform fees follow our Refund and Cancellation Policy.
4. For participants
- When you register for an event, the organizer running it decides what information is collected and how their event is run, including its entry fee and refund terms. Questions about an event go to its organizer.
- Entry fees are paid to the organizer, not to us. Ask the organizer for any refund.
- Signing a waiver or form on The Tourney records your typed name or tick, the time, your IP address and browser, and the exact text you saw. Only sign for yourself or a child in your care.
5. Acceptable use
Don’t use the service to break the law, harass anyone, send spam, upload anything you’re not entitled to, try to get into accounts or data that aren’t yours, or interfere with how the service works. We may suspend or close an account that does. If we have to suspend an organizer during a live event, we will try to give participants reasonable notice where we can.
6. What happens to information over time
Deleting something in the service removes it from view but keeps a record of it — for example, deleting a signed waiver does not destroy the signatures, because they may be needed as evidence. Our Privacy Policy explains what we keep, for how long, and how to ask for access or deletion. Requests about information an organizer collected for their event go to that organizer, and we help them respond.
7. The service itself
- We work to keep the service available but don’t promise it will be uninterrupted or error-free.
- We may change or improve features. If we make a material change to these terms, we will tell you before it takes effect, and may ask you to accept it again.
8. Liability
To the extent the law allows, the service is provided “as is”, and our total liability to you for any claim is limited to the platform fees you paid us in the twelve months before the claim. We are not liable for indirect or consequential losses, for how an organizer runs their event, or for decisions about identity, eligibility or safety. Nothing in these terms limits rights you have that the law does not allow to be limited.
9. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you are a consumer in another country, you keep any protections the law of your own country gives you that can’t be waived.
